Judge to mull an extension of Loughner's treatment (AP)

TUCSON, Ariz. ? The man accused of wounding Rep. Gabrielle Giffords in a deadly shooting rampage is scheduled Wednesday to make his first court appearance since an angry outburst got him kicked out of a May competency hearing.

Jared Lee Loughner's mental status is again the order of business, as a judge decides whether it's likely the 23-year-old can be made competent to stand trial.

But this time around, Loughner will be under the effects of psychotropic drugs, which he has been forced to take the past 60 days.

U.S. District Judge Larry Burns will decide whether to grant prosecutors' request to extend Loughner's stay at a Missouri prison facility by another eight months. A psychologist told the court that Loughner remains mentally unfit to stand trial, but that the extended stay would give him time to improve and become competent.

Burns may also discuss whether to hold another hearing on Loughner's forcible medication.

Loughner has been at the Springfield, Mo., facility the past four months after Burns found him mentally unfit for trial.

The judge's decision followed a May 25 hearing in Tucson in which Loughner interrupted the proceedings with a loud rant. "Thank you for the free kill. She died in front of me. Your cheesiness," he said, according to court transcripts.

Federal marshals whisked Loughner from the courtroom, and he watched the rest of the hearing on closed-circuit TV from a separate room.

Experts have concluded Loughner suffers from schizophrenia.

The judge required Loughner's presence at Wednesday's hearing, even though Loughner's lawyers objected and argued traveling would be disruptive for their mentally ill client.

Loughner wanted to attend the hearing so he could see his parents, who live in Tucson.

Dr. Christina Pietz, a psychologist treating Loughner, is expected to testify that she believes Loughner can be made mentally fit for trial during an extended stay at the Missouri facility.

Loughner's attorneys argue prosecutors have failed to prove such an outcome is probable.

Loughner has pleaded not guilty to 49 charges stemming from the Jan. 8 shooting that killed six and injured 13, including Giffords.

If Burns decides to extend Loughner's stay in Missouri, the judge likely will discuss whether to hold another hearing to determine if Loughner should continue to be forcibly medicated in a bid to make him mentally fit for trial.

Prison officials have forcibly medicated Loughner with psychotropic drugs after concluding at an administrative hearing that he posed a danger at the prison.

Loughner's lawyers have been seeking to have the judge, rather than the prison, decide whether Loughner should be medicated.

Loughner was first forcibly medicated between June 21 and July 1, but an appeals court temporarily halted the medications after defense lawyers objected.

The forced medication resumed July 19 after prison officials concluded Loughner's psychological condition was deteriorating, noting he had been pacing in circles near his cell door, screaming and crying for hours at a time.

Defense lawyers have repeatedly asked Burns and a federal appeals court to halt the forced medications.

Loughner's medications include the sedative lorazepam, the antidepressant Wellbutrin and Risperidone, a drug used for people with schizophrenia, bipolar disorder and severe behavior problems.

Pietz has said Loughner has recently made progress in making more eye contact with people, improving his personal hygiene and pacing less.

But defense attorneys said none of the changes confront Loughner's delusions and noted he remains on suicide watch.

If Loughner is later determined to be competent enough to understand the case against him, the court proceedings will resume. If he isn't deemed mentally fit at the end of his treatment, Loughner's stay at the facility can be extended. There are no limits on the number of times such extensions can be granted.

If doctors conclude they can't restore Loughner's mental competency, the judge must make another decision. If he finds there's no likelihood of Loughner being restored to competency, he can dismiss the charges.

In that case, state and federal authorities can petition to have Loughner civilly committed and could seek to extend that commitment repeatedly.

(AP) ? Dominique Strauss-Kahn claimed Monday he has diplomatic immunity and asked a New York court to dismiss a lawsuit filed by the hotel maid who says he sexually assaulted her.

Attorneys for the former International Monetary Fund leader filed the motion in a Bronx court, arguing judges there do not have the ability to try the case because Strauss-Kahn's time as head of the fund gives him immunity from the litigation.

The 62-year-old Strauss-Kahn was initially charged with attempted rape and held under pricey house arrest after the maid, Nafissatou Diallo, said he attacked her in his hotel suite May 14 and forced her to perform oral sex.

The case was eventually dismissed when prosecutors said they had lost faith in Diallo's credibility after a series of lies she told them unrelated to the assault allegations.

Attorneys for Diallo, who came forward publicly in a series of interviews, filed the lawsuit against Strauss-Kahn in the Bronx Aug. 8 as the criminal case was still active. It recounted in graphic detail the woman's version of the encounter but did not ask for specific damages.

There is a lower burden of proof in civil cases, and it is possible that Strauss-Kahn would have to testify if it went to trial. He recently spoke about the incident at the Sofitel Hotel in an interview broadcast on French television, calling the encounter a "moral failing," but he said it "did not involve violence, constraint or aggression."

The 32-year-old Guinean immigrant maintains Strauss-Kahn attacked her. Her attorney, Kenneth Thompson, said Monday the diplomatic immunity claim would fail because he is not an official diplomat and was on "personal" business when the incident occurred.

"This baseless motion is another desperate attempt to avoid having to answer for the deplorable acts he committed against Ms. Diallo," Thompson said.

The documents filed Wednesday argue that Strauss-Kahn should be immune under international law even though he had already resigned his post as head of the IMF when the lawsuit was filed. His immunity stood until he left the country, shortly after his case was dismissed, his lawyers argued.

Strauss-Kahn's travel documents are stamped "DIPLOMATIC" in bright red lettering, and signed by the secretary-general of the United Nations. The documents recite in six languages that the bearer is entitled to international immunities, according to the court documents.

His attorneys, William Taylor and Benjamin Brafman, also filed a motion to delete paragraphs in Diallo's lawsuit that detail the encounter as fact from her perspective.

The Associated Press does not generally name accusers in sexual assault cases unless they agree to be named or identify themselves publicly, as Diallo has done.

A French writer has accused Strauss-Kahn of trying to rape her in 2003. The two have been ordered to appear before a judge in Paris to tell their stories as part of an investigation into the case. No date for the so-called face-off has been set.

Libyan forces close on Gaddafi loyalists in Sirte (Reuters)

SIRTE (Reuters) ? Libyan provisional government forces backed by NATO warplanes raced through the eastern outskirts of Sirte on Monday, closing in on Muammar Gaddafi loyalists holed up in one of the last two bastions of the deposed leader.

Thick, black smoke billowed into the air as National Transitional Council (NTC) fighters battled loyalist troops at a roundabout about 2 km (1.2 mile) from the center of Gaddafi's home town, Reuters journalists said.

The thud of large explosions could be heard as NATO aircraft roared overhead. NTC fighters said the jets were striking the positions of Gaddafi loyalists.

The advance came two days after anti-Gaddafi fighters west of Sirte drove to within a few hundred meters of its center before pulling back on Sunday to make way for NATO strikes.

On the western edges of Sirte on Monday, NTC fighters and Gaddafi loyalists traded heavy machine gun fire, rocket-propelled grenades and artillery rounds.

Snipers loyal to Gaddafi could be seen on building rooftops. NATO aircraft flew overhead.

NATO would not comment on its operations in Sirte on Monday. It said its planes hit eight targets on Sunday, including ammunition stores and rocket launchers.

Interim government forces have previously retreated from Sirte and the other remaining Gaddafi stronghold, Bani Walid, after poorly organized attacks met fierce resistance from loyalists.

Sirte lies between Tripoli and the eastern city of Benghazi, both now held by the NTC whose rebel fighters overran the capital five weeks ago after six months of fighting.

Taking Sirte would be a huge boost for the NTC, which is trying to establish credibility as a government able to unite Libya's fractious tribes and regions, and a blow for Gaddafi, widely believed to be in hiding somewhere in Libya.

Humanitarian organizations have raised the alarm over conditions for civilians cut off in Sirte and in Bani Walid to the south.

"God willing we can enter Sirte by tonight," NTC fighter, Emad al-Amamy, told Reuters on the eastern edge of the city earlier on Monday.

CIVILIANS TRAPPED

Scores of civilians in cars laden down with personal belongings continued to stream out of the town to both the east and west. NTC fighters checked them, looking for wanted figures among those who were, and may still be, loyal to Gaddafi.

International aid groups are demanding access.

"We are very concerned about the people inside and near Bani Walid and Sirte," Georges Comninos, who heads the International Committee of the Red Cross (ICRC) in Libya, said in a statement.

"Food reserves and medical supplies are reportedly running short in both cities. We are receiving many appeals to help the wounded and come to the aid of civilians generally."

NTC fighters and people who have fled Sirte have alleged that pro-Gaddafi fighters were trying to prevent civilians from getting out of the city, effectively using them as human shields.

"Gaddafi's forces have surrounded the area, closed it off, by shooting at people," said a man called Youssef, driving away from Sirte with his wife. "There are a lot of people who want to get out but can't."

Gaddafi's fugitive spokesman said on Monday that he was in Sirte when it came under attack on Sunday but he refused to comment on the toppled leader's whereabouts.

"I was yesterday in Sirte," Moussa Ibrahim told Reuters in a satellite phone call. "The situation is quite bad."

Ibrahim said Gaddafi was in Libya and "very happy that he is doing his part in this great saga of resistance."

He added that the humanitarian situation in Sirte was dire because the hospital in the city had run out of medical supplies and equipment, and there was a total power outage.

BORDER ATTACK

Gaddafi loyalists showed they were still a threat by launching an attack on Sunday on the desert oasis town of Ghadames, on the border with Algeria, NTC officials said.

It underlined the fragility of the NTC's grip even on parts of the country nominally under its control. The town, about 600 km southwest of Tripoli, is near a border crossing that Gaddafi loyalists have used to flee into Algeria. Its old town, an intricate maze of mud walls, is a UNESCO world heritage site.

Military spokesman Ahmed Bani said the town would be under the control of NTC fighters within days.

The NTC also said on Sunday that it had found a mass grave containing bodies of over 1,000 people killed by Gaddafi's security forces in a 1996 massacre of prison inmates in Tripoli.

The mass grave was the first physical evidence found so far of the Abu Salim prison massacre, an event that was widely spoken of in Libya but covered up for years, creating simmering anger that ultimately helped bring about Gaddafi's downfall.

The uprising that toppled Gaddafi was ignited by protests linked to the Abu Salim massacre. In February, families of people killed there demonstrated in Benghazi to demand the release of a lawyer who had been representing them. Against the backdrop of the overthrow of authoritarian rulers in Egypt and Tunisia, the protests gathered pace and won Western backing.

Despite taking the capital in August, the new rulers say they cannot begin the process that would lead to elections until Sirte and Bani Walid fall. Wrangling over ministerial portfolios has prevented them from forming a caretaker government.

(AP) ? Marathon swimmer Diana Nyad spent more than 40 hours in the shark-filled waters between Cuba and the Florida Keys, climbing into a boat only to be treated for searing welts left by Portuguese man o' war stings. Left swollen and red, Nyad had no choice but to end her trek early when medics warned another sting could be deadly.

The 62-year-old soldiered on for a time, cutting eye and mouth holes into a cap she wore over her face to protect against future stings. She surpassed 100,000 strokes, but the stings ? which team members said left what looked like branding marks from the jellyfish-like creatures' tentacles ? were too much of a risk.

"I trained this hard for this big dream I had for so many years, and to think these stupid little Portuguese man o' war take it down," Nyad told The Associated Press, just hours after getting out of the water. "It's a huge disappointment."

She said she was in the best shape of her life but was blinded by the stings. Late Sunday morning, she heeded the warnings of experts who told her not to continue another two days in the water.

"You go into convulsions, your spine feels paralyzed. I've had kidney stones. Nothing compares to the pain," Nyad said, wearing loose bandages and rehydrating with water and juice on her boat. "It just took the life force out of me."

Nyad arrived Sunday evening in Key West, where she spoke with reporters. She walked off her boat "Sunluver" wearing a white bathrobe, her face and lips swollen from the stings, and pulled up a sleeve to show a long cross-shaped welt on her right forearm.

"It's such a bitter pill," she said. "I am so capable of that swim. That's the end though."

"Because if it was the weather or Tylenol, but those damned jellyfish," she added.

Nyad said that as she swam, she felt paralysis in her back. She recalled swimming through the two stings, which she described as like something out of a sci-fi movie when the tentacles whipped across her.

"I went through two of them and I kept swimming," said Nyad, who wore long pants and a long-sleeved shirt while swimming. Her clothing covered everything but her hands feet and lips, and she got stung in the lips.

"My lips are like Angelina's," she quipped.

But Nyad said she also took pride in swimming for 40 hours, saying she did much better than in a previous try in August. She said visions of the Florida coastline helped keep her going.

"I pictured it," she said. "I really pictured it. I knew I could do it. I just couldn't get there. I wanted that feeling to be on the beach so badly. I'm just not going to have it."

Her team tentatively scheduled a press conference in Key West for Monday morning.

Nyad was making her second attempt in as many months at the Cuba-Florida crossing, a lifelong dream that she first tried as a 28-year-old back in 1978, when she swam inside a steel shark cage for about 42 hours before ending the attempt. A cageless attempt this past August fell short 29 hours in when, gasping for breath, Nyad threw in the towel after an 11-hour asthma attack she blamed on a bad reaction to a new medicine.

Australian swimmer Susie Maroney successfully swam the shark-filled waters from Cuba through the Straits and to the Keys in 1997, though she used a cage. Nyad was trying to become the first to finish it without a cage.

Earlier in her latest swim, Nyad received oxygen and a steroid shot from her doctors and was treading water while she recovered from the stings.

After that, her team said in a website update that a so-called "staged swim record" would still be valid as long as she was on the boat only for treatment and not to rest ? rather than a nonstop record.

Nyad's website said she spent the night trying to recall favorite songs and thinking upbeat thoughts while slipping through the waters under a nighttime sky bristling with stars and a sliver of a crescent moon.

The swimmer faced other obstacles aside from the man o' war stings. On Saturday, handlers spotted barracudas in the area, and she got a visit from a curious Oceanic white tipped shark that was shooed off by a support diver.

Without a cage to protect her, Nyad relied on equipment surrounding her with an electrical field that is harmless but deters most sharks. Her divers are there to gently discourage any who make it through. But not all encounters with marine life were unpleasant. Earlier in her journey, 10 pilot whales emerged in the distance ahead of the swimmer, according to one team tweet.

The Los Angeles woman regularly paused to rest and refuel on food that her assistants passed to her in the water, but without getting on the boat. To maintain her strength she ate pasta, bananas, bite-size pieces of peanut butter sandwiches, and high-calorie and high-carbohydrate drinks.

Dozens of well-wishers flocked to social media sites Sunday after Nyad climbed out of the water, calling her an inspiration.

The athlete in her is still battling disappointment, but Nyad said she's working to gain a positive perspective focusing on the camaraderie from the two-year effort.

"I can live beyond it and think of all the good that's come of it, just to live a life of passion," she said.

AP Sources: Chrysler-UAW talks break down

(AP) ? Negotiations over a new four-year contract between Chrysler and the United Auto Workers have broken down as both sides refuse to budge on key financial issues, two people briefed on the bargaining said Thursday.

The talks ended late Wednesday in a dispute over the number of workers who are paid an entry-level wage, said the people, who asked not to be identified because the negotiations are private.

Chrysler Group LLC, which is losing money, wants no limit on cheaper entry-level workers. The union wants a cap on the number of those workers, who make $14 to $16 an hour, about half of what a longtime union employee earns.

"There was a line drawn in the sand," one of the people said. "Somebody's going to have to give."

Chrysler factories continue to operate under a contract extension.

Detroit's three carmakers are each negotiating labor agreements with the UAW, which represents 113,000 workers at the companies. The new contracts would be the first since two of the automakers ? GM and Chrysler ? nearly collapsed during the recession and needed government bailouts in 2009. Ford Motor Co. didn't need a bailout but took billions in private loans to survive.

GM and the union agreed to a tentative contract last week. Chrysler was expected to be the second Detroit automaker to reach a deal.

Instead, Chrysler and UAW negotiating teams were sent home after the talks resulted in a stalemate. The union said it will now focus on talks with Ford. No more bargaining with Chrysler is scheduled.

The company is against any limit on entry-level workers because it would raise labor costs. About 12 percent of Chrysler's 23,000 factory workers now are paid the lower wage and the carmaker plans to hire thousands more over the next four years as it retools factories to make new models.

The union, on the other hand, wants a deal similar to what GM agreed to ? a 25 percent cap on the number making entry-level pay by the end of 2015, the people said. Then, entry-level workers would have a chance to make higher pay, a key issue for the union. Longtime workers earn about $29 an hour.

Chrysler has more entry-level workers than GM or Ford, and as a result, its hourly labor costs are the lowest of the Detroit companies.

The union agreed to a lower tier of wages in 2007 to help Detroit's carmakers survive financial troubles, and to avoid pay cuts for veteran workers.

Besides setting wages at General Motors Co., Ford and Chrysler, the contracts influence pay at U.S. factories run by foreign carmakers, auto parts makers and other manufacturers.

Before talks broke up, Chrysler and union negotiators extended their current contract. That extension lasts another month.

Negotiators at Chrysler have settled all non-economic issues and were nearing an agreement before the stalemate, the people said. UAW President Bob King was involved in the talks when they broke down, one of the people said.

UAW spokeswoman Michele Martin would not comment.

Talks with Chrysler already were strained before the breakdown. Last week, CEO Sergio Marchionne sent a letter to King accusing him of failing to show up to complete negotiations as scheduled. King wouldn't discuss the letter.

At GM, meanwhile, workers are voting on a tentative deal that gives most of them profit sharing rather than annual pay raises.

The GM deal will be used as a template for the other two companies, but as the breakdown at Chrysler shows, fights will arise over issues unique to each company. GM's deal promises new jobs and car production in the U.S, a top union concern. It also offers buyouts to longtime workers who can be replaced with those making entry-level wages.

GM workers would get a $5,000 signing bonus and profit-sharing checks that will likely exceed the $4,300 workers got this year. Longtime workers won't get a pay raise, but entry-level workers will.

Ford and GM plants continue to run under an extension of the old contract.

In an effort to further bring radio into the 21st century, web-based personalized radio provider Stitcher also available for iPhone) has secured $10 million in Series C funding, thanks to New Enterprise Associates, Benchmark Capital, New Atlantic Ventures and others. The company has now gathered a total investment of $18.7 million in three rounds of funding.

Rather than turn to individual streaming apps of content providers such as CNN and NPR, this free app, available on Android iPhone, BlackBerry and Palm devices, gives users the opportunity to use one central hub to switch between many different programs. Talk, sports, news, entertainment and comedy radio programs are all available on the app, giving users a radio stream on-the-go that does not require additional updates or syncing. Through Stitcher, radio programs are updated automatically and continuously with the most recent episodes and content.

?Stitcher has created for talk radio what Pandora, Spotify, and others have built for music,? said Ravi Viswanathan, general partner at NEA, who will join the company?s board of directors. ?They've made it personalized; they've made it mobile; and they've made it available when and where people want it.? He noted that talk programming in terrestrial radio has spurred a $5 billion advertising market, meaning there is a tremendous opportunity on which to capitalize when it comes to mobile talk radio.

The company plans to use the latest funding to expand its workforce, boost product development and enhance partnerships with content providers, allowing it to expand beyond the more than 6,000 different shows it already streams.
