China manufacturing weakens, services grow

(AP) ? China's manufacturing decelerated further in August while construction and services grew at a slow rate, according to two surveys Monday, adding to conflicting signals about whether the country's slowdown is bottoming out.

HSBC Corp. said its purchasing managers' index fell to 47.6 from July's 49.3 on a 100-point scale on which numbers below 50 represent a contraction. It was the tenth month of decline and the lowest reading since more than three years ago in March 2009.

Manufacturing companies shed jobs at their fastest rate in 41 months, HSBC said. New orders and export orders also declined.

"Beijing must step up policy easing to stabilize growth and foster job market conditions," HSBC'S China economist, Hongbin Qu, said in a statement.

Also Monday, the National Bureau of Statistics said its index of non-manufacturing activity rose to 56.3 from July's 55.6. A sub-index for construction activity rose to 61.1 from July's 60.4. The index also covers industries such as air travel and telecommunications.

China's economic growth fell to a three-year low of 7.6 percent in the second quarter. Analysts expect a rebound by early next year but corporate profits and other indicators have fallen despite government stimulus measures.

Beijing has cut interest rates twice since early June and is pumping money into the economy through higher investment by state companies. Authorities have resisted calls for more aggressive measures after the huge stimulus in response to the 2008 global crisis fueled inflation and a wasteful building boom.

Weak corporate profits are likely to hurt investment, a key pillar of Beijing's recovery plan, meaning the government might have to step up its own spending, analysts say.

The Cabinet minister in charge of China's planning agency said last week that growth was "stabilizing at a slow pace" but gave no details or a time frame for a recovery.

Premier Wen Jiabao and other officials have promised more support for struggling exporters but there is little Beijing can do to boost foreign demand amid Europe's debt crisis and a sluggish U.S. recovery.

A separate survey released Saturday by the government-authorized China Federation of Logistics and Purchasing also showed August manufacturing weakening. The group's PMI fell to 49.2 points ? its lowest level to date ? from July's 50.1.

ESTABLISHING CAUSE and effect is one of the trickiest aspects of medicine. So-called ?causality? can be elusive, especially once you move beyond connect-the-dots type circumstances.

In Marin, we worry and wonder a lot about breast cancer. Why does a particular woman get breast cancer? How does another woman avoid it? These are difficult questions.

There are a litany of possible reasons why one might develop breast cancer. Even if we expand the question to what increases the risk of breast cancer across a broad population, satisfactory answers are slippery. It is with this in mind that we should view the recent evidence regarding breast cancer in Marin County.

It is well documented that Marin has historically had an abnormally high rate of new breast cancer cases. In particular, data from the late 1990s demonstrate breast cancer rates some 15 percent higher than those found across the rest of the state. Multiple culprits ? lifestyle, hormones, toxins and genetics ? have been proposed and studied.

A study recently published in the Journal of the American College of Surgeons has proposed yet another possible cause ? genetic differences in vitamin D receptors. The study, conducted by Dr. Kathie Dalessandri and colleagues, examined the DNA of 164 Caucasian women living in Marin and diagnosed with breast cancer between 1997 and 1999.

They compared their genetic profiles with

those of 174 breast-cancer-free matched controls and found that women who developed breast cancer were 1.9 times more likely to have a specific difference (called a variant) in the gene that dictates how the body utilizes vitamin D (the vitamin D receptor).

Vitamin D has received attention for its possible benefit in deterring certain types of cancers, and animal models have demonstrated that it has a beneficial effect on breast cancer tumor growth. So, differences in how vitamin D is processed by its receptors is a logical explanation for why certain women (in Marin and elsewhere) would be at higher risk for developing cancer.

But before you march out to determine your vitamin D receptor profile, let?s put these findings in prospective.

First, this was a small ?pilot? study and should be considered preliminary evidence. Medical practice and investigation is ripe with prominent associations that have not borne out in larger studies, such as oat bran and heart disease, and ? who can forget? ? vaccines and autism. In fact, there are more disproven associations in medicine than proven ones.

A much larger study of Marin Women (the ?Marin Women?s Study? www.marinwomensstudy.org) with 14,000 participants is ongoing, and analysis of their DNA samples (there are some 8,500 available) should provide more robust data on vitamin D receptor variants and genetic risk. Furthermore, the genetic data from Dalessandri?s study is from 15 years ago, during a time when breast cancer rates were peaking ? especially in Marin. While multifactorial, we know that this peak was, in part, because of combined postmenopausal hormone (estrogen and progesterone) therapy ? a known risk factor for developing breast cancer ? and a treatment more common then in Marin than elsewhere in California. So, we must be careful to extrapolate the findings regarding breast cancer risk from a prior generation to today?s milieu.

Finally, one must always be particularly fastidious when reviewing the results of studies that focus on a specific proprietary drug or test. While this study was funded by state, county and charitable sources, the results quite prominently affect the fortunes of genetic testing company InterGenetics Inc., which is marketing OncoVue, a ?genetic-based, breast cancer risk test.? So, while interactions between genes and the environment is certainly a promising field, the jury on vitamin D receptors and breast cancer is most definitely still out.

Where, then, does this leave us with breast cancer causality? There are some risk factors that we can confidently delineate. Some genetic risk is clearly proven ? and a family history of breast cancer is a known red flag. In terms of risky environmental exposures, an Institute of Medicine committee report released last year summarizes these nicely as ?hormone therapy that combines estrogen and progestin, exposure to ionizing radiation ? excess weight among post-menopausal women and alcohol consumption.?

Other environmental agents ? chemicals such as bisphenol A (BPA) ? have been implicated and are biologically plausible, but at this time they are unproven. Mary Mockus, a surgeon at Kaiser-Permanente San Rafael and a member of the collaborative Marin Women?s Study team, thinks the ?toxic soup? present in higher socioeconomic areas like Marin is likely to play some role in the higher breast cancer rates, but that we are unlikely to ever identify one clear-cut perpetrator. And, this then, fits quite well with what we know about causality in medicine.

So for Marin women, the best advice for preventing breast cancer is probably the best advice for preventing many diseases ? sleep well; get regular exercise; know your family?s medical history and discuss individualized screening plans with your doctor; don?t smoke; avoid excesses of alcohol, drugs and ionizing radiation; and eat plenty of green leafy vegetables. And a healthy vitamin D level ? ask your doctor ? won?t hurt either.

Commentary: The Risky Business of Valuing IP

COMMENTARY | According to widely circulated news reports, the jurors in Apple v. Samsung ignored the testifying experts and calculated damages on their own. Who can blame them? Apple's expert came up with upwards of $2.5 billion as fair compensation for the infringement. Samsung's expert countered with about $500 million. A $2 billion spread makes it hard to trust either analysis.

Valuing intellectual property is risky business, especially when the stakes are high. Investors, regulators, and tax authorities all want to know what a company's technology is worth. If the company doesn't give a straight answer, it risks costly inquiries and investor skepticism.

Unfortunately, a straight answer is hard to come by. Companies have to value IP for all sorts of reasons. And they have to follow different rules, depending on the purpose of the valuation. What if Apple licenses one of its patents to a foreign subsidiary? What if Samsung buys a company with a patent portfolio equivalent to Apple's? Each of those analyses will likely propose a different value for the technology. And chances are slim that either of those values will bear any resemblance to the numbers exchanged last week.

The rules of the road in IP valuation change according to who's driving. If tax authorities are behind the wheel, only a portion of a company's patents may have any value at all. In M&A, financial regulations tend to steer many companies towards high IP valuations. And, while courts typically rely on lost profits and/or reasonable royalty estimates to approximate patent value, juries may well veer off that road and go four-wheeling instead. Small wonder that valuations of the same IP could differ substantially, depending on the analysis. By billions, say.

Tech companies may be thrill-seekers with respect to innovation, but they're pretty conservative when it comes to stuff like financial reporting, tax returns and investor confidence. These audiences don't appreciate miscalculations or uncertainty. Consequently, IP valuation projects must be carefully managed, whatever their purpose. And, even if a company coordinates its multiple IP analyses and carefully controls dissemination of results, it still runs the risk of defending them against a jury's opinion.

If the blockbuster jury award in Apple v. Samsung survives appeal, it could be a game-changer. Technology companies may think twice about risking patent infringement suits. And a decision to steer clear of the courts may require a new approach to innovation. Specifically:

  • "I'll show you mine if?" Tech companies may find it more prudent to cross-license technology to entwine their interests and avoid costly litigation.
  • "If you can't beat 'em, buy 'em." Less successful innovators may snap up their more creative competitors to access the technology they need. While acquisitions are expensive, they avoid high profile lawsuits and brand-damaging jury verdicts.
  • "Since I can't steal your tech, I'll steal your talent." The talent flow between companies may accelerate as competitors lure each other's best and brightest. Companies may find this strategy a relatively cost-effective way to jump-start innovation and cultivate a robust IP portfolio. Even if employers fight back, the stakes shouldn't be as high as they are in patent suits.

Each of the strategies suggested above represents a more conservative approach to IP portfolio enhancement and would result in more cross-licensing, increased M&A activity, and elevated technology salaries. R&D departments may coordinate more closely with finance groups in this environment as companies greet internally generated innovation with more caution.

Intellectual property portfolios represent the crown jewels of successful technology firms. Protecting them is a matter of corporate survival. Unfortunately, assessing their value is a matter of perspective. Litigation introduces yet another perspective, one that may or may not rely on accepted valuation methodologies.

The Apple v. Samsung case may encourage tech firms to take courts out of the valuation equation altogether, by finding new - litigation-resistant - ways to access intellectual property.

JACKSONVILLE, Fla. (AP) ? Republican presidential nominee Mitt Romney plans to spend three days next week preparing for the fall debates.

Romney spokesman Kevin Madden on Saturday said Ohio Sen. Rob Portman will join Romney in Reading, Vt., for sessions at the home of Massachusetts' former lieutenant governor, Kerry Healey. Romney has been reading briefing books and doing other work ahead of the three planned one-on-one debates with President Barack Obama. Portman also played the role of Obama for 2008 Republican nominee John McCain and has been studying material sent from Romney's Boston headquarters.

Romney will prepare as Democrats gather at their convention in Charlotte, N.C. Obama spent the week of the Republican National Convention campaigning in three swing states.

Madden said Romney has no current plans to hold public campaign events next week.

Venezuela's oil refinery reopens after fire

Venezuela's largest oil refinery has resumed production after a massive blast killed 42 people last week, state oil company PDVSA says, according to BBC.

Last Saturday's explosion at the Amuay refinery in the west of the country set oil tanks on fire for days.

The cause of the blast is unclear, but officials have pointed to a gas leak.

Critics have accused PDVSA of neglecting maintenance as it funnels oil revenue into social programmes run by President Hugo Chavez' government.

"Operational activities have resumed safely and gradually" at Amuay, a company spokesman said on Friday.

Two production units with a combined capacity of 160,000 barrels of oil per day are now back up and running, with a third due to restart soon, PDVSA said.
